Terms of service
General Terms and Conditions (GTC) of PraisedClo
1. Scope of Application
These General Terms and Conditions (GTC) apply to all orders placed via our online shop on the PraisedClo website (www.praisedclo.com). The contractual partner is:
PraisedClo
Eelaram Ravikumar
Stolbergstraße 23
12103 Berlin
Germany
Email: support@praisedclo.com
We do not recognize any differing conditions of the customer unless we have expressly agreed to their validity in writing.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By submitting an order via the “Buy Now” button, you make a binding offer to purchase the goods contained in the shopping cart. We will immediately confirm receipt of your order by email. A binding purchase contract is concluded when the order confirmation is sent or when the goods are delivered.
If we discover during order processing that the products you ordered are not available, you will be informed separately. In this case, no contract for the unavailable goods is concluded.
3. Prices and Shipping Costs
The prices listed on the product pages include statutory VAT and other price components.
In addition to the stated prices, shipping costs may apply. These will be displayed to you during the ordering process.
4. Payment Terms
Payment can be made by credit card, PayPal, or another payment method offered in the online shop.
The purchase price is due immediately upon conclusion of the contract. If payment in advance is offered, you undertake to pay the purchase price immediately after conclusion of the contract.
5. Delivery Conditions
We deliver worldwide unless otherwise stated.
Unless otherwise specified, the delivery time is approximately 5–7 business days. Delivery time information is non-binding unless a delivery date has been expressly agreed as binding.
If delivery of the goods fails due to your fault despite three delivery attempts, we may withdraw from the contract. Any payments already made will be refunded immediately.
6. Retention of Title
The goods remain our property until full payment has been made.
7. Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal. Further information on the right of withdrawal can be found in our withdrawal policy.
8. Return Policy
In addition to the statutory right of withdrawal, we offer a 30-day return policy for our products. The conditions and details can be found in our return policy.
9. Warranty
The statutory liability for defects applies to the goods delivered by us.
In the event of a defect, you may initially choose whether subsequent performance shall take the form of repair or replacement. However, we are entitled to refuse the chosen type of subsequent performance if it involves disproportionate costs.
If subsequent performance fails, you may, at your discretion, request a reduction of the purchase price or withdraw from the contract.
10. Liability
We are fully liable for damages resulting from intentional or grossly negligent breaches of duty by us, our legal representatives, or vicarious agents.
In the case of slight negligence, we are only liable for foreseeable, contract-typical damages resulting from the breach of essential contractual obligations (cardinal obligations). Essential contractual obligations are those whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer regularly relies.
The limitations of liability do not apply in cases of injury to life, body, or health, or to claims under the Product Liability Act.
11. Data Protection
We collect, process, and use personal data only in accordance with statutory provisions. Further details can be found in our privacy policy.
12. Applicable Law and Jurisdiction
The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers who do not have their habitual residence in Germany, the application of mandatory legal provisions of the state in which the consumer has their habitual residence remains unaffected.
The exclusive place of jurisdiction for all disputes arising from contractual relationships between us and the customer is our place of business, provided the customer is a merchant, a legal entity under public law, or a special fund under public law.
13. Severability Clause
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the relevant statutory provisions shall apply.
